Understanding Title Deed – The most important document when buying a house in Cyprus


The dream of owning your own home in Cyprus often begins with sea views and palm trees – but the true foundation of any property is an inconspicuous piece of paper: the Title Deed.
If you don't understand or underestimate this document, you risk never really becoming an owner in the worst case.
Here's a simple explanation of what the Title Deed is, why it's so important, and how to make sure everything is legally correct.
What is the Title Deed?
The Title Deed is the official proof of ownership of a property in Cyprus – comparable to the German land register extract.
It proves who is the legal owner of a house, apartment or land.
Without Title Deed, you are not the rightful owner, even if you have paid or are already living in the house.
The Title Deed contains:
  • Owner's name Location
  • & parcel number of the property Building
  • type and usable area
  • Legal encumbrances (e.g. mortgages or liens)

Why is the Title Deed so important?

In the past, there have been many cases in Cyprus where developers or sellers sold properties even though they were not yet registered as owners.
Buyers paid – but the entry in the land register never took place.
With the right title Deed, on the other hand, you are legally protected:
  • No one can dispute the property with you.
  • You can sell, bequeath or mortgage your house.
  • You are officially registered in the land register.

How do I know if an object has a Title Deed?

Your lawyer will check this directly with the Department of Lands and Surveys.
There it is determined:
  • whether the title deed exists,in
  • which name it runs,whether
  • encumbrances (e.g. mortgages) are registered.
Never buy or pay without this check!

If you don't have a title deed yet:

This is not so rare in Cyprus – especially for new buildings.
 There are two cases here:
  1. The Title Deed is in progress:
    The developer has completed the property, but the Land Registry has not yet registered the individual units separately.
  2. No application made or open mortgage:
    In this case, caution is advised! Your lawyer should check whether you can register a so-called
    "Assignment Contract" or "Specific Performance Agreement" – this will protect you until the official transfer of ownership.

How does the transfer of the Title Deed work?
Once all payments have been made and all permits have been obtained, your lawyer will submit the following documents:
  • Sale AgreementProof
  • of
  • Payment
  • Immovable Property Tax ClearancePassport
  • Copies and Tax ID
The Department of Lands and Surveys will issue the new Title Deed in your name.
Duration: 3 to 12 months, depending on the region.

Costs & Fees:
There are fees for the transfer of the title deed:
  • Transfer fee: approx. 3% to 8% of the property value (depending on the price)
  • Stamp duty: approx. 0.15% to 0.20

  • Legal fees: approx. 1% of the purchase price

Tip: If you buy together with your partner, the transfer fees can often be reduced.

Conclusion: Safety first:
The Title Deed is your only legal protection that you are actually the owner.
No matter how beautiful the house or how sympathetic the seller – never buy without a verified title deed or legal protection contract.
Those who buy in Cyprus with patience and good advisors will be rewarded with real property and a clear conscience in the end.

Always ask the broker or seller in writing if there is a title deed – and have it confirmed by the lawyer.
